La Norma UNE-ISO 19601 de compliance penal ha sido publicada.
La Norma UNE-ISO 19601 se alinea con el nuevo Código Penal y su reforma del 2015 y tiene como objetivo prevenir la realización de delitos y reducir el riesgo penal de la empresa.
La Norma UNE-ISO 19601:2017, Sistema de Gestión de Compliance Penal. Requisitos con Orientación para su Uso, se une a las ya publicadas Norma UNE-ISO:37001 antisobornos. Requisitos con orientación para su uso, la Norma UNE-ISO 19600:2015 de cumplimiento legal Directrices, para ayudar a las empresa en su gestión de compliance en sus tres versiones: penal, antisoborno y genérica.
En concreto, la Norma UNE-ISO 19601 publicada ha sido el resultado del trabajo del subcomité técnico de Normalización CTN 307/SC1, Sistemas de gestión del cumplimiento y sistemas de gestión antisoborno, en el que también han participado consultoras, despachos de abogados, universidades, asociaciones de consumidores o asociaciones para la función compliance, entre otros.
Adoptando una estructura de alto nivel que permitirá su integración eficaz con otros sistemas de que disponga la empresa, la Norma UNE-ISO 19601 permitirá que la empresa demuestre que sus acciones y actividades se realizan con la debida diligencia y que se establecen las mejores prácticas para prevenir, detectar, corregir y eliminar los delitos dentro de la misma.
De esta forma, ayuda al cumplimiento del Código Penal reformado en el año 2010 y, sobre todo, a la última reforma del mismo en el año 2015 que iba un paso más allá de la responsabilidad penal de las personas físicas e indica que aquellas empresas que hayan implantado modelos de prevención de delitos pueden demostrar que han actuado con diligencia para prevenir estos delitos, aunque no significa que se exonere o atenúe su responsabilidad de forma automática.
La Norma UNE-ISO 19601 también incorpora buenas prácticas en materia de gestión compliance uniéndose a la tendencia mundial y buscando a través de sus requisitos ayudar a las empresas en las labores de identificación, análisis y evaluación de riesgos penales, así como realizar las comunicaciones de las conductas que sean consideradas potencialmente delictivas y crear una cultura que integre la gestión compliance dentro del ADN de la empresa y de sus decisiones estratégicas.
Por último, la Norma UNE-ISO 19601 se establece como un sistema certificable y está dirigida a su aplicación por todo tipo de empresas sin importar sus dimensiones, actividades, mercado en el que operan o sectores, convirtiéndose en un aliado clave para el futuro de todas ellas.
